Acknowledgement and Acceptance of Terms of Service

By completing the order form and posting it to Mail4me, you are indicating your agreement to be bound by all of the terms and conditions of this service. This agreement comprises the entire agreement between you ("User") and Mail4me for this service and supersedes all prior agreements between both parties.

Description of Service

Mail4me will provide the User with a capability to send and receive electronic mail via the Internet. Users will have the capability to send and receive electronic mail via the SMTP and POP3 mailbox. Each mailbox is limited to 50MB.

The User must:

Provide for the User's own access to the Web and pay all service fees associated with such access.
Provide all equipment necessary for the User to make such connection to the Web, including a computer and modem.

Mail4me may, without penalty, modify this agreement and/or discontinue this service at any time, at which point notification will be sent to the User.

User's Obligations & Conduct

Mail4me offer a professional service. In order to reserve our good name we expressively prohibit the User to, but not limiting to, any of the following:

· Will not use this service for chain letters, junk mail, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process.

· Will not transmit through this service any unlawful, harassing, libelous, abusive, threatening, or harmful material of any kind.

· Agree not to use the service for illegal purposes.

· Transmit any material that contains viruses, Trojan Horses, worms, time bombs, or any other harmful or deleterious material.

The User is responsible for any and all activities that occur from their account. The User must also provide true and accurate information about him/herself on the order form.

Should the User fail to adhere to the term and condition of this service, mail4me reserve the right, at our sole discretion, to terminate this service at any time, without any refund.

Upon being accepted for this service, the User shall receive a password and account name. The User is entirely responsible for maintaining confidentiality of the password and account name. In the event that the User has lost or forgotten the password it is at the sole discretion of Mail4me as to whether the sufficient evidence of the rightful User has been submitted before disclosing any information. Mail4me reserves the right to not disclose any information including passwords.

The User agrees to defend, indemnify and hold harmless Mail4me, its employees and Directors, and their respective successors and assignees from, and against, any and all liabilities, damages, losses, costs and expenses, including lawyer's fees, caused by or arising out of claims based upon the use of your account, including any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property of others.

Mail4me's Privacy Policy & Obligations

Mail4me considers Email transmitted via this service to be private correspondence between the sender and recipient. It is our policy to respect your privacy. We will not monitor, edit, or disclose the contents of your private communications unless required to do so by law.

Mail4me agrees not to:

Disclose your name, address, Email address or any other details to any 3^rd Party unless required to do so by law.
Send Emails to the User apart from; to inform date of next payment; or changes to these Terms & Conditions.

Mail4me reserves the right to change or modify this agreement at any time at our sole discretion. Any changes or modifications will be effective upon posting of a new set of Terms and Conditions on our web site, www.mail4me.co.uk. The continued use of the service by the User will constitute an acknowledgement by the User to abide by the new set of Terms and Conditions.

Mail4me may investigate any reported violation of this Agreement, its policies or any complaints and take action that it deems appropriate and reasonable under the circumstances to protect its systems, facilities, customers and/or third parties. Mail4me will not access or review the contents of any Email(s) except as required or permitted by applicable law or legal process.

Payment and Provision of Notice

Mail4me charge a yearly fee for this service, which is paid in advance via standing order. If the User is not fully satisfied with our service, the User may cancel at any time during the first thirty (30) days from the date on the User's order form and receive a full refund. Thereafter no refund is given. To cancel this service, the User shall notify Mail4me in writing and shall be made either through Email or conventional mail.

When the next yearly payment is due, mail4me will Email the User one month before the due date. This serves as a reminder of the payment date and gives the User the opportunity to cancel the service. The User then has until ten (10) days after the payment date to cancel the service, after which no refund can be given. To do this, the User shall notify Mail4me in writing and shall be made either through Email or conventional mail.

Limitation of Liability

Mail4me shall not be liable for any direct, indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with this agreement, even if mail4me has been advised of the possibilities of damages.

Email Message Storage and Other Limitations

Mail4me assume no responsibility for the deletion or failure to store Email messages. There is no upper limit on the number of messages the User may send or receive through this service. However, there is a 50MB mailbox capacity limit and it is the User's responsibility to manage their mailbox. The User understands that when this 50MB mailbox capacity has been reached, delivery of any new messages will be suspended until space has been freed. This will require Emails to be deleted from the User's inbox and deleted items box.

This service is at the User's own risk and is provided on an "as is" and "as available" basis. The User acknowledges and agrees that mail4me exercises no control over, and accepts no responsibility for the content of the information passing through mail4me's computers, network hubs, servers, or the Internet.

Mail4me retain the right, at our sole discretion, to determine whether or not the User's conduct is consistent with the letter and spirit of this agreement and may terminate the Service if the User's conduct is found to be inconsistent with this agreement, without any refund.
